1. SPONSORS: The Saje x DAVIDsTEA Giveaway (the “Giveaway”) is sponsored by Saje Natural Business, Inc., Unit #600 – 22 East 5th Ave., Vancouver, BC V5T 1G8 (“Saje”) and DavidsTea Inc., 5775 rue Ferrier, Ville de Mont Royal, Quebec, H4P 1N3 (“DavidsTea”) (together, the “Sponsors”). Not sponsored, endorsed, administered by or associated with Facebook, Instagram, X or any other social media platform.
2. ELIGIBILITY: Open only to legal residents of Canada and the United States who are the age of majority in the province, state or territory of residence at the time of entry. Void where prohibited. All federal, provincial, state and local laws and regulations apply. Employees of the Sponsors, their related and affiliated companies, subsidiaries, franchisees, suppliers, partners, prize suppliers, advertising and promotional agencies, Giveaway administrators, and any other parties engaged in the development, production or distribution of Giveaway materials and immediate family members and/or those living in the same household of each are ineligible to enter the Giveaway or win a prize. By participating in this Giveaway, entrants acknowledge compliance with, and agree to be bound by, these Rules. Entrants who do not comply with any of these Rules are subject to disqualification by the Sponsors in their sole discretion. Decisions of Sponsors are final and binding on all matters relating to the Giveaway.
3. GIVEAWAY PERIOD: Giveaway begins on March 17, 2025 at 12:00 a.m. PST and ends on March 20, 2025 at 11:59 p.m. PST (the “Giveaway Period”). The Sponsors’ clock will be the official timekeeper for the Giveaway.
4. HOW TO ENTER: To enter this Giveaway, during the Giveaway Period provide your name, country, province, state or territory of residence, and e-mail address to complete the form available at: https://www.saje.ca/pages/saje-davids-tea-giveaway. Limit of one entry per person and per email address. Automated entries are prohibited, and any use of automated devices will result in disqualification. Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise, illicit means to enter the Giveaway, or any other methods not authorized by these Rules, for example, but not limited to, creating multiple accounts, identities, or registrations, all in the Sponsors’ sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize.

Total Approximate Retail Value (ARV) each prize: $607. Total ARV all prizes: $1214. Winner assumes any and all liability for any injury or damage caused, or claimed to be caused, by entering or participating in this Giveaway or use or redemption of a prize. The prize must be accepted as awarded. Neither the prize, nor any portion thereof, can be combined with other discounts, promotions or special offers. The Sponsors reserve the right to substitute an alternate prize of equal or greater value if the prize is unavailable at time of award.
6. ODDS OF WINNING: The odds of winning will depend on the number of eligible entries received before end of the Giveaway Period.
7. WINNER SELECTION AND NOTIFICATION: The potential prize winners for the prize will be randomly selected from all eligible entries received prior to end of the Giveaway Period.
The potential prize winners will be selected on March 26, 2025 at 10:00 a.m. PST at Unit #600 – 22 East 5th Ave., Vancouver and through email. Each potential prize winner who is a resident of Canada will be required to correctly answer a time-limited mathematical skill-testing question to be administered by the Sponsors or their representative by telephone or another means to be specified by the Sponsors to the potential prize winner. The Sponsors shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason, including but not limited to inactive email account(s), technical difficulties associated therewith, or any potential winner’s failure to adequately monitor any email account. If, despite reasonable efforts, a potential winner does not respond within seven (7) days of the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected. Any potential prize winner may have to sign and return the Sponsors’ Declaration of Eligibility, Liability Release, and (where imposing such condition is legal) Publicity Release, and if requested for US residents, a Form W-9 providing taxpayer information (collectively, “Prize Claim Documents”) prior to receiving the prize. If any potential prize winner is found to be ineligible, or if he/she has not complied with these Rules or declines the prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner may be selected by way of random draw and notified as provided above.
Disputes regarding identity of entrant: If the identity of an entrant is disputed, the entry will be deemed to have been submitted by the Authorized Account Holder (the individual assigned to the e-mail address account associated with the entry) as long as such person is otherwise eligible in accordance with these Official Rules. Each entrant may be required to provide proof that he/she is the Authorized Account Holder associated with an entry.
Prize delivery: Prizes will be mailed to the confirmed winners at the postal address provided by each winner approximately five (5) days from the date all winners are confirmed (shipping and handling provided by Sponsors) provided that the prizes will be delivered only to the addresses within Canada and the United States. The Sponsors ar not responsible for any returned or undeliverable prize and such prize will be forfeited.
Acceptance of prize: All prizes must be accepted as described in these Rules and may not, in any case, be in whole or in part transferred to another person or exchanged for another prize or for cash, except as provided by the Rules.
8. RELEASE AND INDEMNIFICATION: The winner agrees, as a condition of entering into the Giveaway, to release, discharge and hold harmless the Sponsors, their related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, partners, administrators, suppliers, and each of their respective directors, officers, mandataries, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development, production, distribution or execution of the Giveaway (the “Released Parties”) from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of a prize or any travel related thereto, and the use of the entry or information about entrant by the Sponsors consistent with the terms herein, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third party contractor or supplier used in connection with any aspect of the Giveaway to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a winner with any aspect of the Giveaway or any prize, liability for physical injury, death, or property damage which the entrants, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of an entrant’s participation in the Giveaway and/or in connection with the acceptance and/or exercise by the entrant of the prize as awarded; and indemnify the Released Parties and Meta Platforms, Inc. (Facebook, Instagram) and X Corp. against any loss, damage or expense, including legal fees, that any of the Released Parties or Meta Platforms, Inc. or X Corp. may suffer or incur in connection with any claim or demand by any third party, including any third party referred to or depicted in any entry, or as a result of any non-compliance by an entrant with any of the Rules or participation in the Giveaway and/or in connection with the acceptance and/or exercise by an entrant of a prize and the use of the Giveaway entry by the Sponsors.
The Released Parties disclaim all liability for any of the following that may limit or prevent any entrant’s participation in the Giveaway or that could prevent the selection of the winner: malfunctioning of any computer component, software or communications line; loss or lack of a communications network; and any transmission that is faulty, incomplete, incomprehensible or erased by any computer or network. The Released Parties also disclaim all liability for any damages or loss that may be caused, directly or indirectly, in whole or in part, by the downloading of any web page or software or other, and by the transmission of any information related to participation in the Giveaway.
Without limitation each entrant who is a U.S. resident expressly waives and relinquishes all rights and benefits under Section 1542 of the Civil Code of California, and any similar law or common law principle of similar effect in any jurisdiction with respect to the claims release herein. Section 1542 reads as follows: A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.
9. PRIVACY AND OTHER CONDITIONS:
Publicity and entrant information: Entry in this Giveaway constitutes each entrant’s consent to receipt of email and other communications from the Sponsors [MP1] regarding the Giveaway, and receipt of promotional email from the Sponsors concerning their products. Email recipients may unsubscribe from email at any time using the opt-out method provided in the email. By entering, all entrants acknowledge they have read and understand the Sponsors’ Privacy Policies at https://www.saje.com/privacy-policy.html and https://davidstea.com/policies/privacy-policy, respectively. By participating in this Giveaway, entrants consent to the use of their name, address, e-mail address, postal code, telephone number, social media handles, comments and image, whether on videotape, photograph or any other means, and biographical information, all as may be edited, translated or modified in any way by the Sponsors, for the administration of this Giveaway or any publicity carried out by the Sponsors, without further notice or compensation, unless prohibited by law.
Law: The Giveaway is void where prohibited by law and subject to all applicable Canadian and United States provincial, territorial, state, municipal and local laws. For Canadian residents: This Giveaway and these Rules shall be governed by, and construed in accordance with, the laws of the province of British Columbia, without regard to its conflict of law provisions. The sole and exclusive forum and venue for any dispute shall be in Vancouver, British Columbia. For US residents: This Giveaway and these Rules shall be governed by, and construed in accordance with, the laws of the State of California, United States of America, without regard to its conflict of law provisions. The sole and exclusive forum and venue for any dispute shall be in California. Winners are responsible for all local, state and federal taxes on the prize. Any other costs or expenses not specially identified in these Official Rules are the sole responsibility of winner.
Waivers: By entering, entrants agree that (i) under no circumstance may entrant obtain an award for, and entrant hereby waives all right to claim, punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; (ii) all causes of action arising out of or connected with the Giveaway or any prize shall be resolved individually, without resort to any form of class action; and (iii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event will entrant be entitled to receive attorney’s fees or other legal costs.
Giveaway Rules amendments: The Sponsors reserve the right to amend these Rules, or modify, cancel or suspend this Giveaway, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond the reasonable control of the Sponsors corrupts, or threatens to corrupt, the security or proper administration of the Giveaway. If this Giveaway is terminated before the designated end date the Sponsors will (if possible) select another winner(s) in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.
Intellectual Property: All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by each of Saje and DAVIDsTEA, as applicable. All rights are reserved. Unauthorized copying or use of any copyrighted material or other intellectual property without the express written consent of the Sponsors is strictly prohibited.
10. WINNERS’ LIST: A list of the winners may be obtained by sending a self-addressed, stamped envelope to: Saje x DAVIDsTEA Giveaway, ATTN: Stephanie Tung, Email Marketing Manager, Saje Natural Business, Inc., Unit #600 – 22 East 5th Ave., Vancouver, BC, Canada V5T 1G8. International postage required for mail sent from the United States. All such requests must be received within six (6) weeks after the end of the Giveaway Period.
